Commercial and Residential Products Warranty Policy
1.0 Statement of Purpose
This document outlines the limited warranty provided by Noriota Ltd. (the company) for its commercial foodservice and residential equipment. This warranty is a conditional assurance that, under specific circumstances, the company will address defects in material and workmanship. It is not an unconditional guarantee. This limited warranty is valid only for the original purchaser-user of the equipment and applies exclusively to products installed and used according to the usage type and instructions provided in the user manual. All terms and conditions herein are binding, and the company reserves the right to modify the policy at any time, with the current version applicable to products sold from the effective date of this policy.
1.1 Scope of Limited Warranty
The company warrants its new products (the "Products") to be free from defects in material and workmanship under normal and proper use and maintenance. The company’s sole obligation under this limited warranty is, at its discretion, to repair or replace any part or assembly of the Product that is determined to be defective within the specified warranty period.
The warranty period for all Products begins on the date of original installation. To validate this start date, the original purchaser must register the Product with the company within 90 days of installation. If the Product is not registered within this period, the warranty commencement date will default to the factory ship date or distributor sold date, whichever is available. Regardless of the installation date, the warranty period start date will not extend beyond 24 months from the factory ship date.
The duration of this limited warranty is tiered by product category and sales channel:
COMMERCIAL PRODUCTS
- Refrigeration and Ice Machines: Two (2) years parts and labor or One (1) years parts and labor if sold through retail or used in a residential application
- Cooking Equipment: Two (2) years parts and labor or One (1) years parts and labor if sold through retail or used in a residential application
- Replacement Parts: Any genuine company replacement part purchased outside of a warranty claim will be warranted for 90 days from the parts invoice date for parts cost only. This warranty does not include freight or labor charges.
RESIDENTIAL PRODUCTS
- Built-In Undercounter Refrigeration and Ice: Two (2) years parts and labor
- Replacement Parts: Any genuine company replacement part purchased outside of a warranty claim will be warranted for 90 days from the parts invoice date for parts cost only. This warranty does not include freight or labor charges.
1.2 Extended Component Warranties
To provide additional assurance and competitive value, the following key components are covered by extended warranties beyond the standard period:
- Refrigeration Compressors: Additional four (4) year parts-only warranty is provided on all hermetically and semi-hermetically sealed refrigeration compressors. This coverage extends beyond the standard parts and labor warranty, for a total of five (5) years from the date of original installation. The company's obligation under this warranty is limited to supplying a replacement compressor. All labor, refrigerant, and freight charges associated with the replacement are the responsibility of the owner.
- Stainless Steel Fryer Tanks: Additional four (4) year pro-rated parts-only warranty is provided on stainless steel fryer tanks against leaks caused by seam weld failure. This coverage extends beyond the standard parts and labor warranty, for a total of five (5) years from the date of original installation. This warranty is pro-rated, meaning the company’s liability for the replacement cost decreases over time. For example, in the first year, the company will cover the full cost of the part, while in the fifth year, it will cover a reduced portion. All labor, freight, and other costs are the responsibility of the owner.
1.3 Exclusions from Coverage
This warranty is a limited one and does not apply to any failure, defect, or damage resulting from circumstances outside of a defect in material or workmanship. The following circumstances are specifically and expressly excluded from coverage:
- Improper Installation or Use: The warranty is void if the Product is not installed, used, and maintained in strict accordance with the instructions provided in the Product's manual, or if the installation is not performed by a qualified service professional. Damage resulting from a failure to follow these instructions is not covered.
- Improper Electrical Connection: This warranty does not cover component failure or damage caused by improper electrical connections. Such issues include, but are not limited to, using extension cords, power failures, or inconsistencies in voltage, such as drops or spikes.
- Neglect and Improper Maintenance: The warranty does not cover any damage or failure resulting from neglect, including, but not limited to, failure to perform regular and proper cleaning and maintenance routines as specified in the owner's manual.
- Unauthorized Alterations or Repairs: The warranty is void if the Product has been altered, modified, or repaired by unauthorized personnel or if it is fitted with non-genuine company parts.
- External Causes: Damages caused by external factors are not covered. This includes, but is not limited to, fire, flood, wind, lightning, other acts of nature, fluctuations or failure of electrical power, poor water quality, or damage from accidents or mishandling.
- Normal Wear and Tear and Consumables: This warranty does not cover normal maintenance items, consumable parts, or parts subject to normal wear and tear. This includes, but is not limited to, light bulbs, gaskets, seals, and user-accessible fuses.
- Adjustments and Calibrations: This warranty does not cover routine adjustments or calibrations. The installer, dealer, or end-user is responsible for tasks like leveling, tightening fasteners, or making utility connections after the initial setup.
- Exposure to Moisture or Excess Heat: Rust, discoloration, or other damage to products caused by exposure to moisture or excess heat.
- Outside Canada: The warranty is exclusively for products sold and installed within Canada and does not apply to any products sold or used outside of Canada
2.0 Claim Procedures
To ensure an efficient and transparent warranty process, all claims must adhere to the following procedures. Failure to comply with these requirements may result in the denial of a claim.
- Required Documentation: To file a claim, the claimant must provide the following information: the Product's Model Number, the Serial Number, the date of original installation, proof of purchase (such as a bill of sale), and a detailed description of the issue or the repairs performed. If the claimant successfully registered the product through the company’s warranty registration portal, a proof of purchase is not required.
- Submission Timelines: Claims for reimbursement must be submitted to the company or its authorized service center within sixty (60) days of the date the service work was performed. Only work performed by the company’s approved service providers, or pre-approved by the company, will be approved and paid. Claims submitted after this period may be denied.
- Warranty Verification: Before any service work is performed, the service provider should verify the warranty status of the unit. This can be done by providing the model and serial number to the company’s service support center.
2.1 Service and Labor Guidelines
All warranty service must be performed by a service agency authorized by the company. The company’s financial responsibility for labor and travel is strictly limited to the following guidelines:
- Labor Reimbursement: Labor reimbursement will be based on standard straight-time rates and will be capped at predetermined time allowances for specific repairs. For instance, the company will set a maximum number of hours it will reimburse for a specific task, such as a compressor replacement, regardless of the time the service provider actually spends on the job. Charges beyond these standard rates are not covered under this warranty.
- Travel Reimbursement: Travel reimbursement is limited to a maximum of 80 kilometers (50 miles) round trip per completed service call. Reimbursement for travel time is also capped at two (2) hours total. Charges for travel beyond these limits, as well as overtime or holiday labor charges, are not covered under this warranty.
- Parts Handling: Any part replaced under warranty must be a genuine company part. All defective parts for which reimbursement is claimed must be held by the distributor or service provider for a period of sixty (60) days from the date of the claim submission, in the event that the company requests the part for evaluation or testing.
2.2 Transfer of Ownership
This warranty is extended solely to the original purchaser-user of the Product and is not assignable, transferable, or valid for any other owner or user. Any sale, lease, or other transfer of the Product to a second party will immediately void this warranty in its entirety.
3.0 Governing Law and General Legal Disclaimers
This warranty is governed by and shall be construed in accordance with the laws of Ontario, Canada. This limited warranty is the only warranty provided by the company and is in lieu of all other warranties, expressed or implied, that are not explicitly stated herein.
4.0 Limitation of Liability
The company's liability under this limited warranty is strictly confined to the repair or replacement of the Product. In no event shall the company's liability exceed the original purchase price of the Product. The company shall not be liable, under any legal theory, for any incidental, indirect, punitive, or consequential damages. This includes, but is not limited to, damages for loss of use, loss of revenue or profits, cost of substitute equipment, lost products or food, water damage, or any other commercial loss. This broad disclaimer of consequential damages is a critical legal shield that protects the company from a wide range of potential financial claims and is consistent with the policies of leading competitors.
5.0 Enforceability
Should any provision of this limited warranty be deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions of this warranty shall remain in full force and effect. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the entire warranty.
